TERMS, POLICIES & CONDITIONS

These Terms, Policies & Conditions govern all enquiries, bookings, appointments, payments, touring arrangements, Alessia Without Borders arrangements, digital experiences and other interactions with Alessia Vale / Alessia Vale Creations.

They exist to establish clear expectations around consent, payment, safety, screening, privacy, confidentiality, intellectual property and respectful conduct.

My work is lawful work.

My occupation does not diminish my rights to personal safety, privacy, payment, bodily autonomy, consent, protection from fraud or access to the law.

By proceeding with an agreed booking or arrangement, you acknowledge the terms applicable to that arrangement.

Sending money alone does not create a booking, purchase access to me or establish an entitlement to my time.

LEGAL STATUS & LAWFUL WORK

I operate independently and lawfully in jurisdictions in which I accept appointments.

Consensual adult sex work is decriminalised in Victoria and largely decriminalised in New South Wales, subject to the laws and regulatory requirements applying in each jurisdiction.

I am entitled to the same protection of criminal law, property law, fraud law, privacy protections, anti-discrimination protections and other applicable laws as any other person conducting lawful work.

Payment for my professional time does not remove or reduce those protections.

Being a client does not place you outside the law.

WHAT YOU ARE BOOKING

Payments are made for my professional time and the particular companionship, social, travel, digital or other experience that we have expressly agreed upon.

There is no contract for any particular sexual activity.

No booking guarantees any particular physical or intimate act.

Anything occurring between consenting adults remains subject to:

• Mutual agreement
• Free and voluntary consent
• Personal boundaries
• Personal compatibility
• Applicable law

Consent is specific, ongoing and may be withdrawn at any time.

Consent to one activity does not constitute consent to another.

Consent on one occasion does not constitute consent on another occasion.

Payment does not purchase consent.

CONSENT, DECEPTION & PAYMENT

Consent and payment are not areas in which deception will be tolerated.

A person must not obtain my participation through fraud, false payment information, fabricated transaction records, false representations that money has been transferred, deceptive chargebacks or other dishonest conduct.

In New South Wales, legislation expressly recognises that participation in sexual activity because of a fraudulent inducement may constitute an absence of consent.

Accordingly, attempting to obtain an appointment or intimate interaction by producing a false payment receipt, falsely claiming payment has been made or using another deliberate financial deception may have consequences far beyond an ordinary unpaid account.

Where conduct may constitute a sexual offence, fraud or another criminal offence, relevant evidence may be preserved and supplied to police.

PAYMENT FRAUD & FALSE PAYMENT EVIDENCE

Payment must be genuine, authorised and made from a legitimate source.

I have zero tolerance for deliberate payment fraud.

Examples include:

• Falsifying a bank-transfer receipt
• Editing or manufacturing payment screenshots
• Representing a pending, failed or cancelled payment as completed
• Using an account or payment method without authority
• Intentionally cancelling a transfer after presenting it as payment
• Attempting to obtain my time through a payment the payer knows will not clear
• Using stolen financial details
• Making materially false representations to a financial institution about a legitimate transaction
• Fraudulently disputing a payment after receiving the agreed booking, content or experience

A screenshot is not necessarily proof of cleared funds.

Where cleared funds are required before an appointment, the booking will not proceed until I am satisfied that payment has been received.

Where I reasonably suspect fraud, I may preserve:

• Messages
• Booking records
• Payment records
• Transaction identifiers
• Screenshots
• Identification supplied during screening
• Email addresses
• Telephone numbers
• Platform usernames
• Relevant IP, device or account information lawfully available to me
• Hotel or booking information previously supplied

This information may be provided to the relevant financial institution, payment provider, dispute-resolution body, platform, solicitor, insurer or law-enforcement agency where reasonably required.

CHARGEBACKS & PAYMENT REVERSALS

A legitimate chargeback right does not give a person permission to make a knowingly false claim.

If you receive the appointment, digital content, reservation or other agreed experience and subsequently attempt to recover the payment by falsely asserting that the transaction was unauthorised, the service was never provided, you did not recognise the transaction, or another materially false reason, I reserve the right to challenge the dispute and provide supporting evidence.

This may include:

• Booking correspondence
• Confirmation messages
• Screening information
• Evidence of attendance
• Delivery records
• Transaction records
• Time stamps
• Digital-platform records
• Relevant communications before and after the booking

Where I reasonably believe a payment reversal involves fraud or other criminal conduct, the matter may also be reported to the relevant financial institution, payment processor and police.

A payment dispute should never be used as a means of obtaining my professional time or content without paying for it.

DEPOSITS

A deposit is required for all confirmed bookings.

For standard appointments, the required deposit is generally:

30% of the booking fee

Bookings exceeding two hours, extended arrangements, touring commitments, travel arrangements and Alessia Without Borders engagements generally require:

50% of the booking fee

Different arrangements may require a different amount where significant travel, accommodation or other financial commitments are involved.

You will be advised before confirmation.

Do not send money until the arrangement has been agreed.

An unsolicited payment does not create a booking.

PAYMENT METHODS

Depending upon the booking and location, accepted methods may include:

• PayID
• Beem
• Wise
• Revolut
• PayPal
• Another method agreed directly with me

Available methods may change.

Payment instructions supplied privately for a particular booking must not be circulated or published.

The remaining balance is payable at the commencement of the appointment unless agreed otherwise.

CONFIRMATION

An enquiry is not a booking.

Discussing availability is not a booking.

Being given a price is not a booking.

Sending a screenshot is not a booking.

Sending money without approval is not a booking.

A booking exists only after:

• We have agreed upon the date and time
• We have agreed upon the duration and location
• Required screening has been completed
• I have accepted the booking
• The required deposit has been received
• I have confirmed the appointment

No confirmation = no booking.

CANCELLATIONS

Deposits are non-refundable where you cancel.

Please confirm that you are genuinely available before securing an appointment.

Touring appointments, extended engagements, Alessia Without Borders arrangements and other travel-dependent bookings may require accommodation, transport and diary commitments well in advance.

For that reason, cancellation, transfer or rescheduling cannot be assumed.

Any change is at my discretion and subject to availability and costs already incurred.

NO-SHOWS

Failure to attend a confirmed appointment results in forfeiture of payments already made.

The outstanding balance of the missed booking may be required before another appointment is considered.

Repeated no-shows, cancellations or deceptive booking behaviour may result in permanent refusal of future enquiries.

IF I CANCEL

If I cannot honour a confirmed booking, I will offer:

• A refund of funds paid directly to me for the affected booking; or
• Transfer of those funds to another mutually agreed date

Any independent travel or accommodation expenses incurred by you remain your responsibility unless I expressly agreed otherwise.

LATE ARRIVAL & REDUCED TIME

Your appointment begins at the agreed commencement time.

Late arrival does not automatically extend the appointment.

If my diary permits, I may extend the finishing time, but this cannot be guaranteed.

Leaving early or choosing not to use all reserved time does not reduce the agreed booking fee.

SCREENING

Screening is a condition of accepting certain bookings and is undertaken for legitimate safety and security purposes.

Depending upon the circumstances, I may request:

• Full name
• Mobile telephone number
• Email address
• Government-issued photo identification
• LinkedIn or another professional profile
• Employment or professional verification
• Hotel information
• Confirmation of the location I will attend
• Other reasonable information necessary to establish identity and safety

An outcall may require more extensive screening.

A request for screening information is not an invitation to request equivalent private information from me.

My official photographs, professional identity and established online presence provide the information I choose to make publicly available.

FALSE IDENTITY & DECEPTIVE CONTACT

You must communicate honestly about who you are.

Using multiple identities, changing names, repeatedly creating new accounts, moving between platforms without explanation or contacting me through another identity after communication has been declined may be treated as deceptive or concerning behaviour.

Particularly serious examples include:

• Impersonating another person
• Supplying false identification
• Deliberately concealing a previous interaction
• Creating accounts to circumvent a block
• Pretending to be a new client after being refused
• Contacting me from multiple identities to obtain information
• Using another person’s financial account without authority
• Attempting to manipulate screening

Communication may be terminated immediately.

Where conduct raises concerns about fraud, stalking, harassment, identity crime or safety, records may be preserved and the matter may be escalated.

STALKING, HARASSMENT & UNWANTED CONTACT

Repeated unwanted contact is not acceptable.

Do not:

• Repeatedly contact me after being asked to stop
• Create new accounts after being blocked
• Contact friends, family, clients or associates in an attempt to reach me
• Attempt to discover my private residence
• Track my movements
• Follow me between hotels or locations
• Publish private information about me
• Threaten exposure, outing or reputational damage
• Use private information to intimidate me
• Attempt to monitor my devices or accounts

Conduct that may constitute stalking, harassment, threats, extortion, identity crime, technology-facilitated abuse or another offence may be documented and reported.

POLICE & AUTHORITIES

Being a sex worker does not remove my right to report a crime.

If I reasonably believe I have been subjected to fraud, sexual assault, theft, stalking, threats, harassment, identity crime, coercion, blackmail, non-consensual recording, image-based abuse or another criminal offence, I reserve the right to report the matter.

Where appropriate, this may include reports to:

• Victoria Police
• NSW Police Force
• Australian Federal Police
• ReportCyber
• Relevant interstate or international authorities
• Financial institutions and payment providers
• Relevant online platforms

I will not agree to keep suspected criminal conduct secret merely because it occurred in connection with sex work.

PRIVACY & CONFIDENTIALITY

Discretion is reciprocal.

Information collected for screening, bookings, payment, safety and communication will be handled confidentially and used for legitimate purposes connected with operating my business and protecting my safety.

I do not sell booking or screening information.

Information may nevertheless be retained, processed or disclosed where reasonably required for:

• Payment administration
• Fraud prevention
• Screening
• Legal advice
• Debt or dispute management
• Protection of safety
• Enforcement of legal rights
• Compliance with law
• Reporting suspected criminal activity

A promise of discretion is not a promise to conceal criminal behaviour.

MY PRIVATE INFORMATION

My professional identity does not make my private life public property.

You must not attempt to obtain, publish or distribute non-public information including:

• Residential information
• Family information
• Private telephone numbers
• Private email accounts
• Travel itineraries not published by me
• Hotel room numbers
• Accommodation details
• Legal identity information not provided publicly
• Private banking information
• Screening records
• Private correspondence

Information learned because I trusted you with an appointment remains private.

RECORDING

No audio, video, photography or other recording is permitted without my express prior agreement.

This includes:

• Mobile phones
• Cameras
• Smart watches
• Hidden cameras
• Audio devices
• Screen recording
• Remote recording
• AI or digital capture tools

Permission for one specific recording does not constitute permission for any other recording.

Recording without consent may also engage criminal, surveillance, privacy or image-based-abuse laws depending upon the circumstances and jurisdiction.

DIGITAL EXPERIENCES

All digital experiences require prior agreement.

You cannot send payment unexpectedly and then demand immediate:

• Sexting
• Photographs
• Voice notes
• Voice calls
• Video sessions
• Custom content
• Private conversation

Before payment, we must agree upon what is being provided, the price, the platform and the relevant timeframe.

Digital services are prepaid unless expressly stated otherwise.

Private digital material remains subject to my privacy and intellectual-property conditions.

DIGITAL PRIVACY

Unless I expressly agree otherwise, you must not:

• Record a live session
• Screen-record
• Screenshot private content
• Redistribute personalised content
• Upload it elsewhere
• Send it to another person
• Sell it
• Trade it
• Publish it
• Use it for impersonation
• Use it to train or create AI-generated reproductions of me

Changing your username, platform or identity does not extinguish these obligations.

• Used to impersonate me
• Used to create fake profiles
• Commercially exploited
• Altered to falsely represent me
• Used to generate deceptive AI content

Unauthorised use may result in copyright notices, platform reports, hosting complaints and appropriate legal action.

I am not responsible for listings created, scraped, copied, republished or maintained by third parties without my authority.

Use of my name, photographs or text to create an unauthorised advertisement does not make that advertisement mine.

Unauthorised listings may be reported to:

• The website or platform
• Hosting providers
• Search engines
• Copyright channels
• Relevant regulators
• Police where criminal conduct may be involved

SEX-WORK DISCRIMINATION: VICTORIA

Victoria recognises consensual adult sex work as lawful work.

Victorian equal-opportunity legislation specifically protects a person’s profession, trade or occupation, including sex work.

This protection may apply in areas including:

• Goods and services
• Accommodation
• Employment
• Education
• Certain clubs and organisations

I will not accept unlawful discrimination merely because I am a sex worker.

Where appropriate, discriminatory treatment may be challenged through the Victorian Equal Opportunity and Human Rights Commission or another appropriate legal forum.

BANKS & FINANCIAL SERVICES

Lawful sex work does not automatically make fraudulent or discriminatory treatment by financial institutions acceptable.

Where a bank, payment provider or other financial business takes adverse action, I reserve all rights available under:

• Applicable discrimination law
• Contract law
• Financial-services obligations
• Applicable banking codes
• Internal dispute-resolution procedures
• Australian Financial Complaints Authority processes
• Other relevant legislation and regulation

Where I consider a financial institution has closed, restricted or interfered with a service unlawfully or unfairly because of my lawful occupation, I may lodge a formal complaint and seek external review.

Nothing in these Terms represents an acknowledgement that sex work is unlawful or that a payment relating to lawful work is inherently suspicious.

FINANCIAL CRIME & BANKING COMPLIANCE

I understand that banks and payment providers have obligations concerning fraud, scams, money laundering and financial crime.

I will cooperate with legitimate and proportionate compliance requirements where appropriate.

However, genuine compliance obligations should not be confused with arbitrary discrimination against lawful work.

If information is requested or an account is restricted, I reserve the right to seek reasons where available, use internal complaint processes, obtain legal advice and pursue external dispute resolution where appropriate.

NSW SEX-WORK LAW

New South Wales has a long-standing decriminalised framework for much adult sex work, although specific laws concerning premises, advertising, public conduct, planning and other matters continue to apply.

Importantly, NSW consent legislation provides that a person does not consent to sexual activity where participation occurs because of certain forms of fraudulent inducement.

Therefore, deliberately deceiving a sex worker about payment in order to obtain sexual activity is not something I regard merely as an unpaid invoice.

Where the facts indicate that consent may have been obtained through fraudulent inducement, I may report the circumstances to NSW Police.

VICTORIAN SEX-WORK LAW

Victoria’s sex-work decriminalisation reforms recognise consensual adult sex work as legitimate work governed principally through ordinary laws applying to other businesses and workers.

The repeal of the former licensing framework does not remove criminal laws relating to:

• Sexual offences
• Fraud
• Assault
• Threats
• Stalking
• Theft
• Coercion
• Child exploitation
• Trafficking
• Non-consensual conduct

Sex-work decriminalisation means I can seek police protection without my lawful occupation itself being treated as the offence.

RESPECT & PROFESSIONAL BOUNDARIES

My warmth should never be mistaken for unlimited access.

My discretion should never be mistaken for vulnerability.

My occupation should never be mistaken for permission to deceive me.

And payment should never be mistaken for ownership.

Respectful clients are always welcome.

Coercion, dishonesty, harassment, fraud, discrimination and deliberate violations of my boundaries are not.

EVIDENCE RETENTION

Where a booking concludes normally, screening and booking information will be handled according to my privacy practices and legitimate business requirements.

Where a dispute, threat, chargeback, suspected fraud, harassment, stalking, safety concern or potential criminal offence arises, relevant records may be retained for longer where reasonably necessary for:

• Evidence
• Legal advice
• Financial disputes
• Police reports
• Court proceedings
• Platform complaints
• Protection of my safety and rights

Deletion will not be offered merely because a person wishes to prevent legitimate evidence from being used in a dispute or investigation.

TERMINATION OF AN APPOINTMENT

I may end an appointment immediately if:

• A boundary is violated
• Consent is ignored
• I discover false screening information
• Payment proves fraudulent
• I feel threatened or unsafe
• Recording occurs without agreement
• Drugs, weapons or undisclosed persons create a safety concern
• Behaviour becomes abusive, coercive or aggressive

Where an appointment is terminated because of your conduct, no refund should be expected, subject always to rights that cannot lawfully be excluded.

TERMS CANNOT EXCLUDE THE LAW

Nothing in these Terms is intended to exclude, restrict or modify any statutory right, remedy or obligation that cannot lawfully be excluded.

Where these Terms conflict with mandatory Australian law, that law prevails.

CHANGES TO THESE TERMS

These Terms may be updated as my business, travel arrangements, services or applicable law changes.

The version applicable to a particular booking will ordinarily be the version published or communicated when that booking is confirmed, together with any additional conditions expressly agreed for that arrangement.

FINAL NOTICE

Clear boundaries protect everyone.

I conduct lawful work and expect lawful conduct in return.

If you book my time honestly, communicate respectfully, honour your payment obligations and respect my privacy and boundaries, these Terms should never need to become anything more than words on a page.

If you attempt to obtain my time through deception, fabricate payment, fraudulently reverse a legitimate payment, stalk or harass me, record me without consent, misuse my private information, impersonate me or engage in conduct that may constitute an offence, I reserve every right available to protect myself.

That may include preserving evidence, terminating communication, permanently declining further contact, disputing financial claims, reporting accounts or transactions to financial institutions and platforms, obtaining legal advice and reporting suspected criminal conduct to police or other appropriate authorities.

Sex work does not place me outside the protection of the law.

Payment does not purchase consent.

Discretion does not mean silence in the face of crime.
